THE FIRST WORKSHOP WAS HELD ON 12 NOVEMBER 2015 ON THE PREMISES OF THE HIGHER COURT IN NIŠ

On 5th October 2012, Dr. Hans van Loon, then Secretary General of the Hague Conference on Private International Law, officially opened the Center for Private International Law of the Hague Conventions, during the 10th jubilee International Conference on Private International Law (held on 4-5 October 2012 at the Faculty of Law University of Niš). The Center for Private International Law of the Hague Conventions is located on the premises of the Law Faculty in Niš.

    Hague Conference on Private International Law

 

The topics of this Workshop were as follows:

1. General Part of Private International Law (presented by Professor Mirko Živković, Law Faculty Niš):
 
- Legal Sources, with specific reference to the hierarchy between the 1982 PIL Act and other special national legislative acts
- Relation between national legislative acts and international treaties (the „holy“ rule – first verify the (non)existence of international treaty)
- Hierarchy between international treaties in terms of the Vienna Convention on the Law of Treaties (1969) – Application of Successive Treaties relating to the same Subject-Matters (Art. 30 of the Vienna Convention)
  
2. Special Part of Private International Law (presented by dr.sci.iur. Sanja Marjanović, Assistant Professor, Law Faculty Niš) :
 
- International Child Abduction (the 1980 Hague Convention on the Civil Aspects of International Child Abduction) – practical issues
- The notion of the child's habitual residence and how it is to be determined
 
3. International Legal Assistance in Civil Matters (presented by Sanja Stanković, Department for International Legal Assistance in Civil Matters, Ministry of Justice of the Republic of Serbia):
 
- Service abroad of judicial and extrajudicial documents in Civil or Commercial Matters (the 1965 Hague Convention on the Service Abroad of Judicial and Extrajudicial Documents in Civil or Commercial Matters)
- Taking of evidence abroad (the 1970 Hague Convention on the Taking of Evidence Abroad in Civil or Commercial Matters)
 
The participants in this Workshop were the judges of the Basic (formerly Municipal) court and the Higher court in Niš, as well as judicial assistants and interns of these courts.
 
The presentations was followed by a vibrant discussion and interesting questions.
